TERMS AND CONDITIONS FOR TRANSPORTATION

The parties contained in this transport document (HAWB) agree that they are aware and that the following provisions transcribed below are applicable:

 

1. PROHIBITED Materials to be sent through FORMULA LOG:

 

1.1. EBCT Monopoly: We do not carry any mail subject to the EBCT monopoly.

1.2. Other Remittances of Documents and also those classified as Values: Work Card, Passports, credit card, cash, checks of any nature, meal vouchers, transportation vouchers, event tickets and jewelry.

 

1.3. Materials classified as Dangerous Goods: Materials with this specification cannot be transported by FORMULA LOG. Eg: Explosives, Gases, Flammable Liquids, Flammable Solids, Oxidizing, Toxic and Infectious, Radioactive, Corrosive, Miscellaneous (Miscellaneous, eg dry ice).

 

2. RESTRICTED Materials which require prior consultation for their acceptance of shipment or not by FORMULA LOG. They depend on the type of product and its presentation, packaging applied, elements applied to maintain refrigeration and/or ambient conditions, transport and handling conditions, as well as origin/destination involved.

 

2.2. Fragile Items: it is the responsibility of the sender to identify and correctly package the volume that contains fragile shipments. Even so, if, after collection, the probability that it is not properly packaged and marked is identified, the FORMULA LOG unit of origin reserves the right to retain it, as a security measure, and the collection requester is consulted in advance to seek most suitable packaging alternative. FORMULA LOG also reserves the right to refuse the acceptance for transport of orders that present inadequate packaging.

 

2.3. Liquid Articles: liquids that are not classified as Dangerous Goods, only through prior consultation with FORMULA LOG, to verify the possibility or not of accepting shipment.

 

3. The requester and/or sender of the shipment from which this transport document originated is responsible for the accuracy of the information contained therein, not penalizing FORMULA LOG for any damage arising from any incomplete or incorrectly declared data, and FORMULA LOG LOG also reserves the right to charge for delivery.

 

4. Transport insurance is only applied for transporting orders with a declared value of up to R$ 50,000.00 in their Invoice, which must accompany the shipment for proper insurance coverage. For orders with declared values over R$ 50,000.00, the sender is free to contract transport insurance on his own.

 

5. The additional insurance fee applied for international transport will vary depending on the carrier chosen. The percentage will be based on the declared value of the order included in the Commercial Invoice and with the prior agreement of our customer, which will be added to the freight charge by weight.

As for the transport of documents, it is not insured, as a result of this there is no insurance fee.

 

6. The sender is responsible for the correct indication of the payment method item, and if there is no marking, FORMULA LOG will automatically convert the service charge to the sender.

 

7. In cases of freight to be collected from the recipient or from someone other than the sender, the latter must correctly indicate the form of payment. If there is a refusal to accept the freight by the nominees, FORMULA LOG will automatically reverse the service charge to the sender, plus administrative fees. The freight payable modality is only applicable to legal entities.

 

8. FORMULA LOG reserves the right to verify the contents of the package, at any point along the route, regardless of the presence of the shipper, but always in the presence of at least (2) witnesses. If any item is found to be foreign to the declaration of content, transport may be interrupted, reserving the right to charge freight to the final destination. You may also file a lawsuit against the shipper for false declaration, damages and losses or any other legal action that may be applicable.

 

9. FORMULA LOG reserves the right to use the means of transport it deems convenient, whether land, air, sea, river or other, for the completion of the transit of the order contained in this transport document, as well as to transfer the present responsibilities to another shipping company which it decides is convenient to complete the work.

 

10. FORMULA LOG is not responsible for any loss or damage, consequential or special, namely: loss of revenue, profit, market, reputation, bidding, use of content or loss of opportunity. Or other indirect loss resulting from loss, damage, delay, misdelivery or non-delivery of your shipment, even though we are aware of the possibility of such loss or damage.

 

11. FORMULA LOG is not responsible if your shipment or any part thereof is lost, delayed, incorrectly delivered or undeliverable, resulting from:

 

11.1. Circumstances beyond our control such as: natural phenomena, floods, fog, storms and others. Due to force majeure, such as accidents, strikes, delay in releasing the inspection, stoppages of air and/or road transport systems, mechanical problems in the means of transport, defects or vices inherent to the content of the shipment, criminal acts of third parties and parts thereof such such as theft and fire.

 

11.2. Your acts and omissions or those of third parties, such as: the contents of the order consist of any article that is a prohibited item, although we may have accepted the shipment in error.

Responsibilities

FORMULA LOG assumes no responsibility for the deterioration of perishable products or for delays due to weather conditions and/or conditions beyond the control of FORMULA LOG.

Acts of God:An act of God is defined as an abnormal or unusual event that is of strictly natural origin, without human assistance or influence, including, but not limited to, tornadoes, earthquakes, floods, and other catastrophic events of nature.

FORMULA LOG will not be responsible for the loss, damage or delay of any of the goods described in the Bill of Lading caused by an Act of God or public enemies, riots, strikes, a defect or defect inherent in the goods, the act or default of the consigning authority, owner or consignee of law, or differences in the weights of grain, seeds or other commodities caused by natural shrinkage.

FORMULA LOG is not obligated to transport the goods by any particular vehicle or in time to any particular market or with due dispatch, unless by agreement specifically endorsed by an authorized manager of FORMULA LOG in writing prior to removal of the shipment. .

Subject to reasonable requests, FÓRMULA LOG agrees to accept, transport and deliver with reasonable notice the merchandise that the customer may present to FÓRMULA LOG for transportation. However, FORMULA LOG will not be liable for any damages, direct, indirect or consequential, which are the result of delay in delivery.

Stop in Transit:When goods are stopped and held in transit, at the request of the party entitled to do so, the goods are held at the risk of that party.

Shipping Charges:If required by FORMULA LOG, freight and all other legal charges resulting from the goods must be paid before delivery, and if after inspection it is found that the goods shipped are not those described in the Bill of Lading, freight charges must be paid on the goods actually shipped with any additional legally payable charges.

Shipping Indication:If the shipper does not indicate that a shipment must ship prepaid, or fails to indicate how the shipment must be shipped, it will automatically ship as prepaid.

Dangerous Goods:Every person, whether as principal or agent, sending dangerous goods without prior complete information to FORMULA LOG, as required by law, must indemnify FORMULA LOG against loss, damage or delay caused by it and such goods may be stored at risk and expense. of the consignor.

Goods not delivered:a) If the goods cannot be delivered, FÓRMULA LOG will immediately notify the shipper and the consignee that the delivery has not been carried out and will request disposal instructions. b) Pending the receipt of such disposal instructions, the goods will be subject to a storage fee, which will be the responsibility of the consignee of the cargo, and the responsibility for payment by Formula Log should not be transferred.

 

Weights:1. It will be the responsibility of the shipper to show the correct shipping weight of the shipment on the Bill of Lading, including the dimensional weight (cubed weight). The highest weight obtained (actual weight or cubed weight) will be charged. 2. If the weight of the shipment is not in accordance with the weight shown on the Bill of Lading, FORMULA LOG must correct the weight shown on the Bill of Lading, charging the difference in freight later.

 

Additional Fees

Safe:

Fee to be charged: US$0.90 for every US$100.00 or fraction of the total declared value with a minimum fee of US$2.70.

Example:

Shipping with a declared value of US$350.00 will be charged US$3.60 (US$0.90 + US$2.70). Shipping with a declared value of US$475.00 will be charged  US$4.50 (US$1.80 + US$2.70)

The insurance against loss and damage excludes and does not provide protection to packages that are packed incorrectly, or that have been packed with inappropriate material or with adhesive tape that does not comply with the requirements established by Formula Log.

It is the full responsibility of the shipper to ensure that the materials used for packaging are suitable. The declared value fee may be invoiced to the sender, the consignee or a third party.

Protection for National Service:

Protection against loss, damage, breakdown, theft, accidents and misplacement. The maximum declared value and the maximum legal liability is BRL 50,000.00 per shipment (or the equivalent in National Currency). Rate of 0.6% on the amount declared in the Invoice.

The insurance excludes and does not provide protection to packages that are packed incorrectly, or that have been packed with inappropriate material or with adhesive tape that does not comply with the requirements established by Formula Log. It is the full responsibility of the shipper to ensure that the materials used for packaging are suitable.

Fuel Rate:

FORMULA LOG reserves the right to apply a fuel charge for all shipments, without prior notification, according to the rates applied by Cias. aerial.

 

Address Correction:

You will be charged for each package that needs address correction:

National: R$32.62 per package with a maximum value of R$228.34 per shipment

International: US$14.00 per package with a maximum value of US$98.00 per shipment

Big Packs:

A package is considered large when the sum of the width plus the circumference [(2 x width) + (2 x height)] exceeds 300 centimeters, without exceeding the maximum size of 400 centimeters. Large Packages are subject to a minimum billing fee of 40 pounds. The Additional Handling fee will not be charged if the Large Pack fee has already been applied

National: R$186.40 per package - International: US$80.00 per package

Larger Pallet Size:

An additional fee will be charged for some international origins or destinations. Destinations and origins under consultation prior to collection.

International: US$650.00 per pallet

Billing of Customs Fees and Taxes:

When this payment option is selected (delivery with taxes, customs and freight paid by the sender or a third party) an additional fee will be charged. This fee will cover the billing expenses for customs duties and taxes outside the country of destination.

International: US$22.00 per shipment

Missing Account Number or Invalid Account Number:

An additional fee will be charged if the sender does not indicate the consignee's account number when using the Bill to Receiver or Billing of Shipment Costs option, or if it is wrong or has any financial restrictions.

International: US$13.40 per shipment

Expense for Late Payment:

FORMULA LOG reserves the right to apply a charge for late payment on outstanding debts according to current legislation.

 

Extended Areas:

FORMULA LOG offers service in extended areas, as well as in urban areas. An additional fee will apply for each shipment collected or delivered within an extended area. Information on extended areas will be available upon complete address information (with zip code).

National: R$93.20 or R$3.50 per kilogram, whichever is greater

International: US$40.00 or US$1.50 per kilogram, whichever is greater

Risk areas:

An additional fee will be charged for sending domestic shipments to certain zip codes* considered to be at risk. Information on extended areas will be available upon complete address information (with zip code).

National: R$34.95 or R$3.50 per kilogram

Undeliverable Package:

Packages sent by domestic services that have been returned by the recipient or that could not be delivered for some reason independent of FORMULA LOG, will be returned to the sender and charged by the same. Packages that have not been delivered are subject to shipping and fuel fees. The Service Guarantee does not apply to Undeliverable Packages that are returned to sender.

National: The fee is based on the freight rate plus an additional fee of R$23.30

 

Return of Undeliverable International Shipments: Regardless of billing options, for all international shipments refused by the recipient, or which were not possible to deliver for any reason beyond FORMULA LOG's control, we will contact the exporter for further instructions. Shipping costs, taxes, fees and an additional return fee will be charged to the sender if requested for each undelivered shipment. The Service Guarantee does not apply to Undeliverable Shipments that are returned to sender.

International: Shipping costs and return taxes plus an additional fee of US$10.00;

Return of Billing to Consignee:

If the consignee or third party of a shipment refuses to pay shipping costs or fails to pay for any other reason, an administrative fee will be charged to the sender in addition to shipping and any other expenses incurred during the return to sender process.

International: $13.40 per shipment

Maximum Limits Exceeded:

Packages with an actual weight greater than 70 kg, or packages that, when measured to determine the billing weight, exceed 274 centimeters in width, or that exceed a total of 400 centimeters in combined width and circumference [(2xwidth)+(2xheight )], are not accepted for transport. If found in the FORMULA LOG transport system, they will be subject to one or more additional fees

National: : BRL 1,514.50

International: : US$650.00

 

Additional Handling Fee:

The Additional Handling Fee may apply to international and domestic shipments. The fee will apply in the following cases:

  • Any item that is packed in a box made of metal or wood.

  • Any cylinder-shaped article such as a barrel, cube, bucket, or tire that is not completely wrapped in corrugated paper.

  • Any package whose widest side exceeds 122 cm, or the second widest side exceeds 76 cm.

  • Any package whose actual weight or actual weight exceeds 32 kg.

  • Each package that belongs to a multiple-package shipment, where the average weight per package exceeds 32 Kg., and the weight of each package is not specified in the documentation or in the FORMULA LOG shipping system used.

The Additional Handling Fee will not be charged when the Large Pack fee is applied.

FORMULA LOG reserves the right to apply the Additional Handling Fee on any package that, according to FORMULA LOG descriptions, requires additional handling.

National: R$27.96 per package

International: US$12.00 per package

Customs Services

Informal customs clearance fee:

If the tax amount is less than R$500.00: US$19.00 fee

If the tax amount is from R$501.00 to R$1,000.00: Fee of US$22.00

If the tax amount is greater than R$1,001.00: US$28.00 fee

 

Fee for lack of CNPJ/CPF:

Shipments that arrive with no CNPJ/CPF on the commercial invoice. Fee of US$12.00

 

Retention fee for value assessment:

Shipments held by customs for proof of market value. Fee of U$19.00

Taxes for informal release:

Import Taxes 60% + ICMS

 

Storage fee (ABV):

ABV's warehouse service is US$0.82 per kilo, fee paid at the airport

 

Anticipation of Taxes:

Service and costs arising from the advance payment of taxes to the Federal Revenue, such as import taxes and ICMS. Fee of 0.50% or BRL 2.00

 

Services with consenting bodies:

Monitoring, advising on the elaboration and preparation of documents for the release process on arrival of imports of goods consenting to Anvisa. Fee of BRL 95.00

 

Deconsolidation:

Administrative service for checking and separating the documentation of import shipments for the customs clearance process by other agents (other than the courier company): R$230.00

 

Formal Export:

  • Formal export fee DU-E Single Export Declaration (SISCOMEX). Formal Submission for sales or other purposes. Fee of US$23.00 per shipment.

  • RE with no declared value limit. Formal Submission for sales or other purposes. Fee of US$23.00 per shipment.
